Behavioral evidence for the COVIS dual‐process model of category learning has been widely reported in over a hundred publications (Ashby & Valentin, ). It is generally accepted that the validity of such evidence depends on the accurate identification of individual participants' categorization strategies, a task that usually falls to Decision Bound analysis (Maddox & Ashby, ). Here, we examine the accuracy of this analysis in a series of model‐recovery simulations. In Simulation 1, over a third of simulated participants using an (...) Explicit (conjunctive) strategy were misidentified as using a Procedural strategy. In Simulation 2, nearly all simulated participants using a Procedural strategy were misidentified as using an Explicit strategy. In Simulation 3, we re‐examined a recently reported COVIS‐supporting dissociation (Smith et al., ) and found that these misidentification errors permit an alternative, single‐process, explanation of the results. Implications for due process in the future evaluation of dual‐process theories, including recommendations for future practice, are discussed. (shrink)

The concept of legitimacy is often used and emphasized in the context of setting limits in health care, but rarely described is what is actually meant by its use. Moreover, it is seldom explicitly stated how health-care workers can contribute to the matter, nor what weight should be apportioned to their viewpoints. Instead the discussion has focused on whether they should take on the role of the patients’ advocate or that of gatekeeper to the society’s resources. In this article, we (...) shed light on the role of health-care workers in limit setting and how their conferred legitimacy may support subordinators’ (i.e. citizens’) conferred legitimacy. We argue that health-care workers have an important role to play as both moral and political agents in limit setting, and delineate normative conditions that justify and facilitate health-care workers in conferring legitimacy on this kind of decision. Their role and potential impact on political limit setting does not—theoretically—affect the idea of democratic legitimacy negatively. Rather, as we suggest, by designing for limit-setting policymaking accordingly, health-care workers, as well as citizens, are more justified in conferring democratic legitimacy to health-care limit-setting decisions than if these concerns were not addressed. Coral bleaching has impacted reefs worldwide and the predictions of near‐annual bleaching from over two decades ago have now been realized. While technology currently provides the means to predict large‐scale bleaching, predicting reef‐scale and within‐reef patterns in real‐time for all reef users is limited. In 2020, heat stress across the Great Barrier Reef underpinned the region's third bleaching event in 5 years. Here we review the heterogeneous emergence of bleaching across Heron Island reef habitats and discuss the oceanographic drivers that (...) underpinned variable bleaching emergence. We do so as a case study to highlight how reef end‐user groups who engage with coral reefs in different ways require targeted guidance for how, and when, to alter their use of coral reefs in response to bleaching events. Our case study of coral bleaching emergence demonstrates how within‐reef scale nowcasting of coral bleaching could aid the development of accessible and equitable bleaching response strategies on coral reefs. Providing heroin to heroin addicts taking part in medical trials to assess the effectiveness of the drug as a treatment alternative, breaches ethical research standards, some ethicists maintain. Heroin addicts, they say, are unable to consent voluntarily to take part in these trials. Other ethicists disagree. In our view, both sides of the debate have an inadequate understanding of voluntariness. In this article we therefore offer a fuller conception, one which allows for a more flexible, case-to-case approach in which some (...) heroin addicts are considered capable of consenting voluntarily, others not. An advantage of this approach, it is argued, is that it provides a safety net to minimize the risk of inflicting harm on trial participants. (shrink)

Wood, Kressel, Joshi, and Louie thoroughly evaluate the evidence for menstrual cycle shifts in ratings of several male characteristics and conclude that their analyses fail to provide supportive evidence for consistent cycle effects. The topic of menstrual cycle shifts in mate preferences has been strongly debated, with disagreements over both scientific content and practice. Here, we attempt to take a step back from these acrimonious exchanges and focus instead on how to interpret menstrual cycle shifts in mate preference tasks, independently (...) from the question of when, or if, task performance varies with cycle stage. A greater consideration of domain-general mechanisms could provide an opportunity for investigating how evolved predispositions interact with socially transmitted information in biasing women’s responses on mate preference tasks. Researchers from diverse disciplines, including organismal and cellular physiology, sports science, human nutrition, evolution and ecology, have sought to understand the causes and consequences of the surprising variation in metabolic rate found among and within individual animals of the same species. Research in this area has been hampered by differences in approach, terminology and methodology, and the context in which measurements are made. Recent advances provide important opportunities to identify and address the key questions in the field. By bringing together (...) researchers from different areas of biology and biomedicine, we describe and evaluate these developments and the insights they could yield, highlighting the need for more standardisation across disciplines. We conclude with a list of important questions that can now be addressed by developing a common conceptual and methodological toolkit for studies on metabolic variation in animals. (shrink)

This book is a splendid piece of editing. Its format is tripartite: a consideration of specifically Husserlian themes, such as intersubjectivity, reduction, the life-world, intentionality, and constitution by distinguished Husserlian scholars and, in two instances, Husserl himself; the translation and adaptation of phenomenology into existential phenomenology, the illustration of which is centered around selections from Heidegger, Sartre, and Merleau-Ponty with commentary support from Kockelmans, Schrag, Edie, Kwant, Natanson, and Spiegelberg; the exemplary deployment of phenomenology into the area of the human (...) sciences, particularly psychology. In this last part the uniformly solid though sometimes non-harmonious interpretations of the relation between phenomenology and psychology are proffered by Merleau-Ponty, Sartre, Kockelmans, Strasser, and Schuetz. This book would provide excellent supplementary reading for any course in phenomenology or existential phenomenology, and, in addition, for any course in the philosophy of the social sciences.—E. A. Eighteen of Gurwitsch's papers, all previously published between 1929 and 1961; nine of the papers appear in English for the first time. With the exception of the mainly expository "The Last Work of Edmund Husserl," in which Gurwitsch limns the structure of Husserl's Krisis, all of the papers are serious forays into "constitutive" as distinguished from "existential" phenomenology. At times Gurwitsch goes about his business historically, engaging Descartes, Kant, a good deal of Hume, James, and, of course, Husserl in dialogue. (...) In almost half of the papers Gestalt psychology, the psychological and biological work of Gelb and Goldstein, and the distinctively psychological work of James are the focus. The dominant theme of all the studies is consciousness and an exploration of the logical rather than existential problematic of intentionality. Gurwitsch wishes his work to be assessed as part of the Husserlian program of radically founding in the constituting consciousness all the systematized noematic fruits, i.e., sciences, of this same consciousness.. He is, however, a self-confessed heretic from the strict Husserlian point of view, having abandoned the doctrines of hyletic data, and, more interestingly, the egological root of consciousness.—E. A. Some philosophers have maintained that even if John R. Searle’s attempted derivation of an evaluative proposition from purely descriptive premises is successful, moral ought would not have been derived. Searle agrees. I will argue that if Searle has successfully derived “ought,” then, based on various approaches taken towards the content of “morality,” this is moral ought. I will also trace out some of the benefits of a successful derivation of moral ought in relation to natural law ethics. I sketch a (...) possible derivation of moral obligations based on one of the basic goods in natural law ethics (i.e., friendship) that resembles Searle’s attempted derivation of an individual’s obligation to keep her promise to someone else. I also sketch a possible derivation of moral obligations based on another of the basic goods in natural law ethics – knowledge. This derivation may not parallel Searle’s attempted derivation as closely as the derivations based on friendship, but it seems to at least involve the derivation of moral obligations from all non-moral premises. At one point in this engaging collection of essays, G. E. R. Lloyd describes Aristotle's "sense of the interdependence of philosophical analysis and detailed empirical investigation", a description which fits the author himself. Lloyd is sensitive to the peculiarities of Aristotle's texts without sinking so deeply into their oddities that they lose focus and theoretical interest. With admirable lucidity Lloyd lays out the complex requirements of Aristotle's "official" theory of scientific demonstration, and then discusses the ways in which Aristotle's scientific (...) practice sometimes fits, and sometimes influences, the theory. Lloyd provides a pluralist interpretation of Aristotelian scientific method, and then demonstrates the ways Aristotle complicates his theory in order to fit the messy natural world. (shrink)

In order to approach the phenomena of responsibility, which is primarily liability and accountability, the author suggests a phenomenological clarification of the question: What is the precondition that makes a responsible life possible? This question should enable to give an answer to another one which is from high anthropological and even political relevance, namely: Is there a spot beyond or "outside" of any responsibility, i.e. can a human being live as "irresponsible" in the radical meaning of the word? The main (...) thesis of the author is that there is a situation in which a human being has no means to act by making any "own" choices and thus everything in his life is imposed to him from the outside. This situation is the nativity and, more concretely, the time-space of the pre-natal human life. The aim of this paper is to analyze this situation by means of Husserl's phenomenological reduction as well as of the "counter reduction" of Michel Henry, and consequently to propose a new understanding of the responsibility problematics. For more than a century, phenomenology’s relation to history has remained a problem for phenomenological analysis. This can in part be attributed to the circumstances surrounding the beginnings of phenomenology. As Europe moved increasingly toward world war at the turn of the 20th century, a growing consciousness of the historical relativity of all values and knowledge spread throughout the continent, leading Ernst Troeltsch to speak of the “crisis of historicism” (Rand 1964, 504-5). In this same context, Edmund Husserl framed phenomenological (...) analysis in opposition to history. While Husserl recognized the “tremendous value” that history has to offer philosophical thinking, he believed that a purely historical reduction of consciousness necessarily results in the relativity of historical understanding itself, like a serpent that bites its own tail (Husserl 2002, 280). If phenomenology was to be a genuine science, it had to attempt a phenomenological reduction which would seize upon the essence of our historical being, i.e., our essence as beings that exist within history and are inseparable from it. What was required over and beyond a historical understanding of lived experience was an analysis of the structure of historicity itself (293-4). (shrink)

Switzerland is internationally known for its progressive animal laws and for its innovative tools in law enforcement. In 1992, the Canton of Zurich introduced a public lawyer vested with the task of representing animals’ interests in criminal procedure, known as the Animal Protection Lawyer. The APL had the power to access information about court proceedings, study pending court cases, and intervene on behalf of victim animals. This enforcement tool set a precedent across the world. It amounted to a recognition of (...) animals as de facto victims and created an “equality of arms” for human and animal parties in criminal procedure. In a historic move in 2014, the Zurich parliament removed the APL from office—by mistake, as some maintain. Meanwhile—unnoticed by many—the Canton of Berne maintained a state agency vested with the very same powers as those the APL had, called the Dachverband Berner Tierschutzorganisationen. Though the DBT operated as an established agency for over 2 decades, in August 2017, a criminal court in Berne denied the DBT standing, arguing that the laws conferring on it the right to represent animals violate the federal law on criminal procedure. In July 2018, the Supreme Court delivered its judgment, and effectively stripped the DBT of its rights to represent animals in criminal proceedings. This article describes these recent shifts in criminal animal law in detail and analyzes the sociopolitical factors that gave rise to them. Special attention is paid to the question of what is left for Switzerland as a role model in animal law given ongoing deregulations, particularly as recent cases in the United States point to an incremental emancipation of animals as victims. The article discusses current alternatives to the APL and the DBT and puts their promises under scrutiny. The analysis reveals that these alternatives skirt the main obstacles faced by animals in criminal procedure and threaten the democratic will of the Swiss people. Two alternatives are discussed that can help Switzerland overcome its insufficiencies: the organizational right to appeal and victim rights for animals in criminal procedure. Using these alternatives, the article calls for the global emancipation of animals as the proper victims of crimes and for furnishing them with correlating rights to enforcement, including rights to representation. In order to protect nonhuman animals effectively, animal law must overcome many hurdles, be it the balance of human and nonhuman interests, the use paradigm, or narrow definitions of legal personhood or basic rights. A fact often overlooked in this uphill struggle is that the laws of most states recognize that animals must be protected because and to the extent that they are sentient. The legal recognition of animal sentience seems to nullify all and any attempts to deny them legal (...) protection simply because they are not sufficiently appealing, emotionally close, or economically useful to us. However, the legal recognition of animal sentience does not overcome all our cognitive prejudices about animals. Using a comparative law method and insights from moral philosophy, this article analyzes the nature and scope of the legal recognition of animal sentience. It identifies its advantages in challenging arbitrariness and inconsistency and championing intrinsic animal protection and points to the most pressing shortcomings, including some states’ refusal to commit themselves to animal sentience and remaining prejudices in society and science. In concluding, the article offers ways to address and remedy these shortcomings and points to ways in which the concept can be used more effectively by academics and practitioners. (shrink)

The last phase of Greek philosophy has until recently been less intelligently studied than any other, and in our understanding of its development there are still lamentable lacunae. Three errors in particular have in the past prevented a proper appreciation of Plotinus' place in the history of philosophy. The first was the failure to distinguish Neoplatonism from Platonism: this vitiates the work of many early exponents from Ficinus down to Kirchner. The second was the belief that the Neoplatonists, being ‘mystics,’ (...) were necessarily incomprehensible to the plain man or even to the plain philosopher. To have encouraged the persistence of this superstition in the nineteenth century is the least pardonable of Creuzer's many sins. The third was the chronological confusion involved in the ascription to Saint Paul's contemporary of the works of the pretended Dionysius Areopagita, which contain a fully-developed Neoplatonic theology. Though the fraud had been exposed by Scaliger, these writings continued down to the beginning of the nineteenth century to be used as evidence that the ‘Nsoplatonic trinity’ was an inferior imitation of the Christian one. When this false trail was at length abandoned the fashion for orientalizing explanations persisted in another guise: to the earliest historians of Neoplatonism, Simon and Vacherot, the school of Plotinus was ‘the school of Alexandria,’ and its inspiration was mainly Egyptian. Vacherot says of Neoplatonism that it is ‘essentially and radically oriental, having nothing of Greek thought but its language and procedure.’ Few would be found to-day to subscribe to so sweeping a pronouncement; but the existence of an important oriental element in Plotinus' thought is still affirmed by many French and German writers. Dementia is a growing issue at the end of life that presents unique challenges for advance care planning. Advance directives are a useful and important component of end-of-life planning, but standard advance directives have less utility in cases of loss of capacity due to dementia. An advance directive designed to specifically address end-of-life issues in the setting of dementia can provide patients with increased autonomy and caregivers with improved information about the desires of the individual in question. The Dartmouth Dementia (...) Directive is a dementia-specific advance directive, available online, that seeks to address common concerns of individuals who are planning for dementia-related end-of-life care. This directive was piloted in a community-based workshop, which provided important details and perspective on the best use of dementia-specific advance directives in the greater population. (shrink)

Much of the legal and social interest in new neuroimaging techniques stems from the belief that they can deliver on the materialist understanding of the relationship between the brain and the mind. This article looks at predictions about the future both of scientific advances and of social reactions to those predictions. It looks at the likely technical limits on neuroscience-based mindreading, then at the likely limits in how the law might use such technologies. It describes three kinds of technical barriers (...) to detailed and useful mindreading: the likely impossibility of making a complete and accurate model of a human brain in light of its incredible complexity, the problems of interpersonal and intrapersonal plasticity, and the problem of trying to read, now, someone's past mental state. The potential changes to the operation of the law, through the use of mindreading as evidence of pain, deception, or bias, among other things, could be extremely important. (shrink)
